La Compagnie d’assurance titres Chicago définit un prêteur privé comme un prêteur hypothécaire qui n’est pas une banque à charte, une compagnie de fiducie, une caisse populaire, une compagnie d’assurance ou une compagnie de finance qui est agréée par la Société canadienne d’hypothèques et de logement en vertu de la Loi Nationale sur l’Habitation. Des mesures spéciales ont été mises en place pour protéger les prêteurs privés et les juristes impliqués dans les transactions de prêt hypothécaire par un prêteur privé.  Ces mesures comprennent, sans toutefois s’y limiter :

  • Questions additionnelles pour la souscription
  • Documents pertinents supplémentaires

Ces changements sont basés sur les tendances du secteur immobilier où les transactions frauduleuses sont à la hausse dans le secteur des prêts privés.

Private Lenders

Chicago Title defines a private lender to be any lender which is not a Chartered Bank, Trust Company, Credit Union, Insurance Company or Mortgage Finance Corporation. Chicago Title follows the same criteria as the Canada Mortgage and Housing Corporation. To find out more about the lenders that are not considered a private lender please visit the National Housing Act Approved Lenders on the CMHC website: www.cmhc-schl.gc.ca.

Special measures have been implemented to protect the lenders and the legal professionals involved in private lender mortgage transactions against fraudulent transactions. These measures include, but are not limited to:

  • Additional underwriting questions
  • Additional relevant documents

These changes in our procedures are based on real estate industry trends where fraudulent transactions are on the rise in the private lending space.

Examinez attentivement les pièces d’identité avec photo :

  • La date de naissance concorde avec l’âge de la personne que vous avez devant vous.
  • Agrandissez la copie des pièces d’identité afin d’examiner les signatures.
  • Il n’y a aucune faute d’orthographe dans le nom ou dans toute autre information.
  • N’hésitez pas à demander des questions additionnelles. Par exemple, le type de voiture si un permis de conduire vous est présenté.
  • Demandez une facture d’électricité ou de gaz afin de valider les informations.
  • Confirmez la validité du permis de conduire avec le service en ligne de l’organisme gouvernemental responsable de l’émission de ceux-ci.

Soyez vigilants lorsque l’emprunteur est une enterprise :

  • Assurez-vous que les personnes qui signent au nom de l’entreprise disposent de l’autorité appropriée.
  • Demandez des questions additionnelles si des modifications aux informations sur l’entreprise ont été produites.
  • Vérifiez le livre des minutes de l’entreprise.

Informez-vous quant à la propriété qui est donnée en garantie, plus particulièrement les propriétés suivantes :

  • Terrain vacant
  • Propriété louée. Êtes-vous certain d’avoir affaire au véritable propriétaire?
  • Plusieurs transactions récentes ou une propriété libre de toute hypothèque depuis plusieurs années.

Le passé peut déterminer le futur

L’assurance titres est unique en son genre.  La couverture d’assurance protège contre une réclamation future résultant d’un problème qui a été créé ou qui était latent avant l’acquisition de la propriété.  Ces risques sont beaucoup moins évidents que pour l’assurance automobile mais peuvent être tout aussi dévastateurs.  L’assurance titres résidentielle protège le propriétaire assuré ou le créancier hypothécaire assuré contre les problèmes de titres, les irrégularités démontrées à un certificat de localisation et contre la fraude immobilière.

Les obilgations de la compagnie :

Obligation de défense des droits de l’assuré dans l’immeuble

L’obligation de défense dépasse le cadre de l’indemnisation de l’assuré lors d’une réclamation.  Comme assureur titres, nous sommes responsable des coûts, honoraires juridiques et dépenses encourues pour défendre un risque assuré, incluant le titre de propriété ou une charge contre le titre.

Couverture sans égard à la faute

L’assuré est indemnisé par Chicago pour la perte sans égard à la commission d’une faute.  En prouvant sa perte, l’assuré peut présenter une réclamation valide.

What is title insurance?

TITLE INSURANCE —

A CONTRACT WHEREBY THE INSURER AGREES TO INDEMNIFY:

  1. The owner of a real estate property against the actual loss or damage incurred in the event of a defect affecting the title to the land.
  2. The mortgage lender against the actual loss or damage incurred in the event that title is defective and / or if its security is not enforceable against title to the land.

Summary of General Coverage

Existing Risks prior to the Date of Policy:

  • Fraud or impersonation (before or after the Date of Policy)
  • Defects or irregularities that would have been revealed by an up to date survey, certificate of location or real property report
  • Non-compliance with municipal by-laws (ex. zoning, setbacks)
  • Notice of violation of a zoning by-law
  • Encroachment
  • Lack of access rights
  • Undisclosed property tax arrears or erroneous statement of account
  • Construction liens or legal hypothec for work started before the Date of Policy*
  • Errors in the public records
  • Incorrect legal description or cadastral designation
  • Undisclosed arrears for common expenses (re: condo / strata)
  • Failure of the condominium or strata to be validly created

*Legal Construction Hypothecs

In Québec, the risk of legal construction hypothec under article 2726 of the Civil Code of Québec may be covered to the extent that the Company’s underwriting requirements are met. If such coverage can be provided to the owner, legal construction hypothecs will be insured to the extent that they arise from services and materials provided prior to the date of policy unless the owner has agreed to pay for such services and materials.

The Company reserves the right at all times to change the coverage provided based on any additional information or new events that come to its attention.

SCOPE OF THE COVERAGE:

  • INFLATION: The residential owner policy provides protection for the increase in fair market value up to a maximum of 200%.
  • COMPLETE COVERAGE: The insured always benefits from the full coverage of the title insurance policy, even if the policy is underwritten for a specific problem. Unknown risks existing as of the Date of Policy will be covered.
  • TO EACH ITS OWN TITLE INSURANCE POLICY: The loan policy does not cover owner and the owner policy does not cover the mortgage lender.

COVERAGE FOR KNOWN DEFECTS:

Upon underwriting analysis, the owner / purchaser of a real estate property will benefit from coverage during their period of ownership against a claim for a known defect covered by the terms of the title insurance policy.  In the event of the resale of the property to a third party, the title insurer undertakes to title insure the following purchaser under the same conditions, provided premium is paid.

EXCLUSIONS FROM COVERAGE:

  • The government’s power to regulate and legislate.
  • The government or quasi-government’s power to expropriate.
  • Any default, charge, hypothec, priority or other right created, tolerated, agreed or assumed by the insured or that does not entail any real loss to the insured.
  • Risks known to the insured but which have not been disclosed to the Company.
  • Real estate taxes that are not due and payable as of the Date of Policy.
  • Mineral rights and mineral extractions rights.
  • Compliance with the legal provisions relating to the protection of the environment.

Title insurance does not protect against problems related to the property assessment, its market value, the physical condition of the building, environmental issues or the insured’s misrepresentations.

LIFE OF A TITLE INSURANCE POLICY:

  • The title insurance policy takes effect from the date of execution by all parties of the instruments creating the interest insured by the policy.
  • The policy remains in effect as long as the owner has a right in the insured property (for the homeowner) and as long as the debt secured by the mortgage has not been fully reimbursed (for the lender).
  • The title insurance policy is transferable to the insured’s heirs, spouse or children or to a trust of which the insured is the author.

TITLE INSURANCE PREMIUM:

Tile insurance policies are issued for a one-time premium. Premium is paid at the time the title insurance policy is issued and the policy will remain in force as long as the insured retains an interest in the property.
