Application

These Terms of Use (the “Terms” or “terms and conditions”) apply to websites, online platforms, and mobile applications (collectively, the “Sites”) in the control of Chicago Title Insurance Company its successors and assigns, and its majority-owned subsidiary companies (“we,” “us,” “our,” “CTIC,” “Chicago Title Insurance Company – Canada Branch”).

Agreement To Be Bound – Use of Our Sites

Use of our Sites is in accordance with the following terms and conditions. We may change these terms and conditions at any time without notice to you and therefore you should review them prior to accessing our Sites.  By accessing our Sites you will be deemed to have agreed to these terms and conditions.  If you do not agree with these terms and conditions, do not access our Sites. 

Limited Permission To Use Information and Documents On Sites

Subject to the Disclaimer and Prohibited Uses herein we do grant limited permission to use the information and any documents (such as white papers, press releases, datasheets and FAQs) from the Sites, provided that (1) you use them solely for informational and non-commercial or personal use only and they will not be copied or posted on any network computer or broadcast in any media, and (2) you do not make any modifications to any such information or documents. Use for any other purpose is expressly prohibited by law, and may result in severe civil and criminal penalties.

Disclaimer

CTIC is in no way responsible for direct, indirect, special or consequential damages, however caused, connected to your use of our Sites.  The information posted on our Sites is for informational and educational purposes only and although we believe the information on our Sites to be accurate and reliable when posted we cannot guarantee this to be the case at all times.  We suggest you obtain applicable advice (including legal advice if necessary) prior to acting or relying on it.  Any links provided on our Sites to other websites are for convenience only and we make no endorsement of any third party products, services or information, either expressly or implied, concerning any such products, services or information referred to or included on our Sites or linked from or to our Sites.  We cannot represent or warrant that access to our Sites will be available, meet your requirements, be uninterrupted or that there will be no delays, difficulties in use, loss of information transmitted or that they will be free of viruses or other harmful destructive properties.  It is your responsibility to ensure you have in place appropriate measures to protect your computer systems from such viruses or other harmful destructive properties.    

Prohibited Uses

By accessing or using our Sites, you agree that you will comply with all applicable laws and not use the Sites for any purpose that is prohibited by these terms and conditions. 

You may not use the Sites

• in any format that could interfere with the operation of the Sites, the server(s) on which the Sites are stored, or any associated server, computer or database;
• to interfere with any other party’s use and enjoyment of our Sites;
• to access or attempt to access any portions of the Sites which are password-protected, secure or nonpublic areas that you are not authorized to access; or
• to obtain or attempt to obtain, modify or create derivative works from any materials or information through any means not intentionally made available through our Sites or any service(s) that may be afforded by them.

Intellectual Property

The Sites and their content, features, and functionality are and will remain the exclusive property of CTIC and its licensors. The Sites are protected by copyright, trademark, and other laws of Canada the United States, and other applicable foreign countries. Our name and logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CTIC and its affiliates or licensors. No logo, graphic, sound or image (trademarks and trade dress) from any CTIC Sites may be copied or retransmitted unless expressly permitted in writing by CTIC.  You have no right, title, or interest in or to the Sites or any of their contents. All rights not expressly granted are expressly reserved by CTIC.

Privacy

We respect and are committed to protecting your privacy.  Our use of personal information is governed by the provisions of our Privacy Policy.  We recommend that you read the Privacy Policy prior to submitting personal information on the Sites. You consent to CTIC’s collection, use, and disclosure of personal information as described in the Privacy Policy.

Indemnification

To the fullest extent allowed by applicable law, you agree to indemnify and hold harmless CTIC and its licensee and licensors, and their employees, contractors, agents, officers and directors, affiliates, service providers, successors, and assigns, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees), resulting from or arising out of your use and access of the Sites, use and access of the Sites by any person using your credentials, your alleged violation or breach of these Terms, or the content posted on the Sites. 

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and by accessing our Sites you agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario to finally adjudicate or determine any suit, action or proceeding arising out of or in connection with the Sites.
